Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Linking Arts website (the "Site") and any inquiries you submit through the Site. The Site is operated by Linking Arts, LLC ("Linking Arts", "we", "us", or "our"), a New Mexico (USA) limited liability company.

1. Using the Site

You may use the Site only if you can form a binding contract with us and only in compliance with these Terms and all applicable laws.

2. Inquiries and professional services

The Site is intended to provide information about our software engineering and consulting services, including web and mobile application development and UX/UI design.

Any professional services we provide are governed by a separate written agreement (such as a master services agreement, statement of work, or similar contract). If there is a conflict between those agreements and these Terms, the written services agreement will control for that engagement.

3. Acceptable use

You agree not to:

• Attempt to gain unauthorized access to the Site or related systems.
• Interfere with or disrupt the integrity or performance of the Site.
• Use the Site to transmit malware, spam, or other harmful code or content.
• Use automated means to access the Site in a way that imposes an unreasonable load.

4. Intellectual property

The Site and its content (including text, graphics, logos, images, and design) are owned by Linking Arts or our licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Site or included content unless you have our written permission.

5. Third-party links

The Site may contain links to third-party websites. We do not control and are not responsible for third-party websites, content, or practices.

6. Disclaimers

THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LINKING ARTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

8. Indemnification

You agree to defend, indemnify, and hold harmless Linking Arts and its members, managers, employees, and contractors from and against any claims, damages, liabilities, losses, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Site or violation of these Terms.

9. Governing law

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict of laws principles.

10. Changes to these Terms

We may update these Terms from time to time. We will update the effective date above when we make changes.
